Nakamura says Ngiraingas ministry lacks jurisdiction on airport screening

This is Nakamura’s response to the letter of Minister Jackson Ngiraingas regarding grounds for the takeover.

Nakamura said that the Palau National Aviation Authority is the proper agency to oversee aviation security screening functions.

“I hereby notify you that my position is that RPPL No. 5-19 controls the issue you raise and under its applicable provisions you and the ministry that you currently head have no jurisdiction to meddle or even take such issues up, much less take the action of having the government take over the aviation security screening functions,” Nakamura stated.

Nakamura however said he still wants to meet with Ngiraingas to discuss the issues.

Earlier, Ngiraingas stated strongly in his letter that he will no longer re-discuss with him the government’s reason for the takeover.

Ngiraingas also accused Basco of being uncooperative.

Nakamura however said voicing out an opinion doesn’t mean he is being uncooperative.

“I have tried time and time again to cooperate with you in resolving an issue you have created on your own without prior consultation and contrary to the existing law,” Nakamura stated.

He also said that he places high priority over national interests because if not done so his business will crumble.

“The nature and continued viability my aviation security screening business is contingent upon the national security interest being top priority consideration over any private business interests including mine,” Nakamura stated.

He added that the government cannot just takeover without due process.

The government said that it is serious in taking over and initiating the transition phase of transferring the passenger and baggage security screening services to the security division of the Bureau of Aviation.

The minister said Palau is taking a proactive measure in securing its airport facility.
