NMI court issues $3.59M default judgment against IPI parent company

THE Superior Court Clerk of Court on Wednesday issued a $3.59 million default judgment against Imperial Pacific International LLC’s parent company, IPI Holdings Limited, in favor of a Mongolian company, Junson Construction LLC.

Junson Construction, through attorney David Banes, sued IPI and its parent company last year for breach of contract, unjust enrichment, quantum meruit, promissory estoppel, promissory fraud, and unfair/deceptive business practice.

The complaint asked the court to issue an order awarding plaintiff $3.59 million in compensatory damages, including interests and other relief.

In 2019, Junson Construction agreed to provide IPI with Mongolian workers for its casino resort construction in Garapan, the lawsuit stated.

“Under this arrangement, IPI would employ the referred workers to work on specific portions of IPI projects, pay the referred workers their wages, and pay Junson, depending on the progress of the work on those specific portions, compensation for its services,” the lawsuit stated.

It added that amount of compensation due and payable to Junson Construction is $5,186,026.12.

IPI, which faces other lawsuits filed by former vendors and former employees in federal and local courts, has only made three payments amounting to $1,588,026.

Since at least January 2021, there has been a balance due and payable to Junson Construction in the amount of $3,598,000.12.

Junson Construction said it has repeatedly demanded IPI to pay up.
