OAG not going forward with Hattig plea

HAGÅTÑA (The Guam Daily Post) — The Office of the Attorney General will not be going forward with a plea agreement in John Hattig Jr.’s 2021 drug and gun possession case.

Last week Wednesday, Hattig’s attorney, Peter Santos, from the Alternate Public Defender division, informed The Guam Daily Post he received an email from the AG’s office that said they will no longer be going forward with the plea agreement for Hattig.

According to Post files, Hattig was set to plead guilty to possession of a controlled substance and possession of a firearm. He was set to be sentenced to one year in prison, all of which would have been suspended.

Acting chief prosecutor Gloria Rudolph from the AG’s office further confirmed with the Post they would not be going forward with Hattig’s plea deal. When asked if Rudolph could explain why they were not going forward with the plea deal, the Post did not receive a response as of Friday afternoon.

In light of the information, Santos told the Post he believed the decision by the OAG was “vindictive and politically motivated.”

“There was already an offer, and it was accepted,” Santos added.

Arrest

Hattig was arrested and charged in July 2021 after the Guam Police Department received a call about a man who had what looked like a firearm walking around Mai’Ana Airport Plaza in Tamuning.

Officers responded and found the man, later identified as Hattig, walking from an Infiniti sedan into the Mai’Ana Airport Plaza complex while carrying what appeared to be a firearm, according to a magistrate’s complaint.

Officers then asked if they could check his bag. Hattig said there was a gun in the shoulder bag and that he had taken the gun from his friend who had argued with his girlfriend. In the bag, officers found a pistol, plastic baggies containing methamphetamine, pills and a digital scale.
