Subris who was represented by Counsel Mark Doran asked the court for an order declaring a run-off election but the Commission through Assistant Attorney General Nelson Werner asked for a summary judgment.
Associate Justice Kathleen Salii on Tuesday ruled from the bench and dismissed the suit.
Salii ruled in favor of the Commission’s motion for summary judgment.
The court’s ruling favors the Palau Election Commission’s declaration of the winner of the Ngaraard State General Election which was held on November 12, 2009.
In that election incumbent Governor Laurentino Ulechong won by 45 percent over Subris and other gubernatorial candidate Albert Shiro.
The result was certified on November 23 and Ulechong is scheduled to be sworn-in next week.
Justice Salii has yet to issue a written order.
On Tuesday an oral argument was held before Justice Salii.
Doran argued for Subris while Assistant Attorney General Ronald Ledgerwood argued on behalf of Werner and Counsel Rachel Dmitruk argued on behalf of Governor Ulechong.
Doran argued that Palau Election Commission violated the laws when they did not declare a run-off election between Ulechong and Subris.
Doran said that Ngaraard State Constitution mandates that a run-off election will be held in case no one among the candidates get majority of the votes of more than 51 percent of the votes.
Dmitruk argued that Subris had no right to seek for run-off election and that the Commission did not violate any laws when they officially declared a winner.
Subris, a former teacher and a candidate at the Ngaraard State General Election on November 12 sued Santos Borja, Benjamin Yobech, Dominica Ngoriakl and Laurentino Ulechong, the incumbent Governor and the official winner in the recently held election.
She claimed in her complaint that if a run-off election was held she would get more votes than Ulechong.
She losed to Ulechong by 72 votes.
