THE Office of the Attorney General’s Criminal Division has asked the Superior Court to dismiss without prejudice the theft charge against Liva Marie Seman Fitial on Tuesday, a day before the Dec. 29 preliminary hearing.
Superior Court Associate Judge Joseph N. Camacho granted the motion to dismiss on Tuesday. Dismissed without prejudice means that the case can be re-filed.
In her motion to dismiss, Attorney General Heather Barcinas indicated that the government “may conduct further investigation.”
Fitial, 39, was accused of stealing and forging several personal checks, and selling several pieces of home furniture and appliances of her mother-in-law.
The victim reported the theft incident to the police on Dec. 12, 2021.
Police also talked to a person who said she bought several pieces of furniture from Fitial in late August and in September. She said she wanted her money back from Fitial before she would surrender the furniture.
Assistant Public Defender Vina Seelam was appointed by the court to represent Fitial.
