Superior Court Associate Judge Kenneth Govendo directed Fitial, 26, not to consume any alcoholic beverages in public and private places, as among his pretrial release conditions.
Fitial posted $1,000 bail shortly after his initial appearance on Monday. He also issued $1,000 in unsecured or appearance bond.
He was arrested for assault with a dangerous weapon, and disturbing the peace.
Fitial was also directed not to have any contact with his victim Scot Thompson, and Jong Sung Kim.
Another MMA fighter, Maitai K. Charley, 26, failed to post $3,000 bail imposed by Govendo.
Facing the charge of disturbing the peace, criminal mischief, and assault and battery, Charley was remanded to DOC custody.
Fitial and Charley were both arrested on Friday based on arrest orders by the Superior Court.
During oral arguments for his initial appearance on Monday afternoon, Assistant Attorney General George Hasselback and Assistant Public Defender Matthew Holley argued on the basis of the charge of assault with a dangerous weapon as Fitial’s fists – a first impression on the CNMI judiciary.
In his affidavit, Detective Jackson W. Jack pointed out Fitial’s record being an MMA fighter.
Thompson reported to police on Feb. 12, 2010 that Fitial, reeking in liquor at the time, threw about 15 to 20 punches to his face for no apparent reason.
The incident happened by Beach Road in Garapan parking meter, south of The Flair.
Thompson was about to leave in a car with a friend, Jong Sun Kim, as the driver, when Fitial passed by in another vehicle and shouted at them, police said.
Thompson said Fitial kept on shouting “faggots” at them, when he asked Fitial, “Is there a problem?”
“That’s when Fitial threw about 15 to 20 punches to [Thompson’s] face,” Jack said.
With the flurry of Fitial punches, Thompson tried to block the punches, at the same time trying to remove his seat belt on the passenger side seat and to get out of the car.
With a hurting left eye, Thompson told police he and his friend left the area.
It took days for Thompson to report to the police, with a black eye, fearing for his life.
Govendo directed Charley not to have any contact with his victims.
In his affidavit, Detective Sabino P. Cabrera said DPS dispatched its personnel to Winchell’s in Susupe for a criminal mischief and assault and battery incident on Feb. 6, 2010.
Charley punched the front passenger door and kicked it three times without warning or any reason after he approached the vehicle of Mr. and Mrs. Fernando, police said.
As Charley followed Mrs. Fernando who ran towards Winchell’s, the defendant pushed and kicked Chito Cristobal in the face.
Cristobal’s 10-year-old son witnessed the incident. He is now traumatized, like having nightmares since the night of the incident. Police said the child is also suffering from bowel disorder.
Cabrera noted that Charley is a well-trained MMA fighter.
