Kagman rape defendant pleads guilty

Superior Court Associate Judge David A. Wiseman accepted the guilty plea and scheduled the sentencing for Nov. 17.

Assistant Attorney General Brian D. Gallagher said Santos, 21, is facing a maximum jail sentence of 30 years, or a fine up to $10,000.

Gallagher said the plea agreement will be voided if Santos fails to comply with all of the terms.

Santos’ defense counsel, Joseph James Norita Camacho, said his client could face a jail sentence of below 10 years or higher than 20 years.

Camacho said the other charges against his client will be dropped: kidnapping, conspiracy to commit kidnapping, sexual assault in the first degree, aggravated assault and battery, and disturbing the peace.

As part of the plea agreement signed on Aug. 2, 2010, Camacho said his client will also cooperate with the government in prosecuting the case.

He said they informed the Attorney General’s Office and the Department of Corrections about the threats against Santos in connection with his plan to testify against his three co-defendants.

According to Camacho, this is the reason why his client was separated from Joseph Cabrera Camacho Jr., 31; Ivan Jones Castro, 33; and Alfred P. Hocog, who turned 18 last August while in prison.

These other defendants have denied the charges against them.

The court has imposed a $100,000 bail on each of the  defendants and they remain incarcerated at the Department of Corrections facility.

Santos was the first defendant arrested by the police while the rest were taken into custody one after the other.

Santos claimed he only served as the lookout for the group.

On June 15, the AGO said the four defendants kidnapped and raped the victim at Tank Beach.
