Superior Court Associate Judge David A. Wiseman sentenced the 18-year-old Palacios to one year imprisonment, all suspended except for 25 days, with credit for five days time served at the Department of Corrections facility.
Palacios is expected to be released from jail on Oct. 17, 2010.
Palacios has signed a plea agreement, and admitted the charge of criminal mischief.
The court granted the CNMI government’s motion to dismiss all other counts against Palacios.
The Attorney General’s Office charged Palacios with assault and battery, assault, burglary, two counts of criminal mischief, criminal trespass, criminal contempt, and violating an order of protection, and disturbing the peace.
Upon release from prison, Palacios will be placed on supervised probation for the remainder of his suspended sentence.
Palacios is also required to pay $506 as restitution to his victims, a $100 fine, a $25 court assessment fee, and a probation fee to be determined by the Adult Probation Office.
Palacios will complete 50 hours of community work service, not to possess any illegal firearms, and obey all federal and CNMI laws.
On March 31, 2010, Palacios entered the residence of Edward Dela Cruz, Precilia Dela Cruz, and Mercedes Torres Dela Cruz, the defendant’s former girlfriend, the prosecution said.
In the process, Palacios broke the house glass window and bathroom door when the defendant tried to talk to Mercedes who hid in the bathroom.
