Defendants in Rota fruit bat poaching case need more time to file motions

Attorneys Michael Dotts, Bruce Berline, and Ramon Quichocho formally filed their stipulation on Friday.

Assistant U.S. Attorney Eric O’Malley, the prosecutor, also signed the stipulation.

The federal courts scheduled for Nov. 8 the jury trial for Adrian Mendiola, David Santos, and Albert Taitano who were released on their own recognizance.

They were ordered to refrain from going near within one mile of, or firing a weapon at, any fruit bat colonies, on top of other pretrial release conditions.

The three denied the charges.

According to the indictment, the incident occurred on or about Nov. 1 to Dec. 19, 2008,

In a statement, U.S. Attorney for the District of Guam and the NMI Alicia A.G. Limtiaco said the Mariana fruit bat, or “fanihi” is an important species not just to the islands’ ecology, but to the local island culture. She said the endangered species “belongs not just to the people of this generation, but to future generations as well, and it is important that we allow them to repopulate and thrive.”
