Through her counsel Colin M. Thompson, Xuan Bo Lu filed the complaint in federal court against Jian Chao Hou, Gui Hua Hou, Xiao Qin Ma Huo and five “Does.”
The court told the defendants that they have 20 days to answer Lu’s complaint.
Lu is asking for a jury trial.
In Oct. 2008, the complaint said Lu paid $1,000 to the defendants in exchange for her work permit.
Lu was hired on Oct. 16, 2008 as a masseuse.
The defendants paid Lu by commission basis and not for the hours she worked, the complaint stated.
It added that the defendants failed to pay Lu’s overtime compensation in the amount of one and one-half times her regular pay rate for all of the hours worked by her in excess of 40 hours in each work week.
World Massage also failed to maintain full and accurate records of the hours actually worked by Lu, the complaint stated.
The Variety tried but failed to get a comment from World Massage.
