Fireman, companion arrested for assault

At the time of the incident, a pole dance contest was being held inside the bar, police said.

Firefighter Dewain Borja, 41, and Anthony Dela Rosa Palacios, 22, were arrested shortly after the incident on the charge of assault and battery and assault with a dangerous weapon against Borja and assault and battery against Palacios.

Police identified the victim as Manny Villagomez who sustained a one-inch cut on his head.

Superior Court Associate Judge Kenneth Govendo retained the $6,000 bail for Borja and $1,000 bail for Palacios during their initial appearance yesterday.

Assistant Attorney General Brian Gallagher argued for the government while Assistant Public Defender Richard Miller represented the defendants.

Department of Public Safety spokesman PO2 Eric David said on March 14,  at about 1:06 a.m., off-duty Police Officer Jason Tarkong called DPS and reported the incident.

In his affidavit, Detective Roque K. Camacho said responding Officer Catherine B. Pangelinan saw a group of people holding Villagomez who shouted: “F*** you Dewain, if I die come to my funeral.”

Pangelinan interviewed a woman who was then standing beside the victim.

The woman told police that Borja had hit Villagomez with a beer bottle.

Pangelinan then interviewed Darrel Salas, a bouncer, who said that he saw Villagomez exit the door and then saw Anthony Palacios  and Jack Palacios also leaving the bar.

Salas said he heard Villagomez tell a joke to Borja.

“After the joke, they both started arguing and Villagomez was asking Borja as to why Borja was telling the two Palacios to slap and punch him,” Camacho said.

Salas told Pangelinan that he then saw Anthony and Jack Palacios walking up to Villagomez while Borja hit the victim on the left side of his head with a beer bottle.

Anthony and Jack Palacios jumped on Villagomez, causing the victim to “fall back onto the balcony breaking it, then down to the ground and then they started punching Villagomez,” police said.

The police report did not explain why Jack Palacios wasn’t arrested.
