Federal jury trial for DYS jail guard rescheduled

Visiting Senior Judge Robert J. Bryan granted the oral motion for waiver of speedy trial argued by attorney Loren A. Sutton on behalf of his 24-year-old client.

The federal court earlier set the jury trial for Fitial on Aug. 9.

Sutton said he has a civil trial also in federal court on Aug. 16, leaving him “little time to prepare.”

“The majority of the discovery thus far received in the instant case is heavily redacted and counsel has not yet had an opportunity to see the un-redacted document. There has been no proffer received to date and no discussion of a possible plea bargain,” Sutton stated in his written motion.

Assistant U.S. Attorney James J. Benedetto, the prosecutor, did not object to the request.

Federal agents arrested Fitial last month on the charge of one count of deprivation of rights under color of law.

Fitial has denied that he coerced his victim, by means of force and threats, to engage in sexual acts while the victim was a ward of the Kagman Juvenile Detention and Correctional Facility from Oct. 2009 through February this year.
