Kolmar Datius and Nelson Saimon, both 22, were charged with theft and conspiracy to commit burglary by the Attorney General’s Office.
Naraja said his decision to dismiss Datius and Saimon from the case was based on the government’s presentation of what the evidence would have been had the matter gone to trial.
“The basis for this dismissal was not in bad faith and the evidence would have been insufficient,” the judge added.
Two other defendants — Alberto Villanueva, 23, and Marvin Ringlen, 19 — have signed a plea agreement.
Villanueva got three years in prison, all suspended except for 32 days, for conspiracy to commit burglary.
The court credited the 25 days Villanueva already served at Corrections.
He was also placed on probation for 11 months and 28 days, and was ordered to pay fees and fines.
Ringlen was sentenced to a three-year jail term but all suspended, with credit for the 95 days he already served at Corrections.
Ringlen was placed on probation for the remainder of the sentence.
