After hearing oral arguments of both parties and testimony of the proposed third party custodian, Florentina Hocog Garuw, 49, the defendant’s mother, Inos denied the motion.
Assistant Public Defender Richard Miller filed the motion on behalf of Hocog.
Aside from the proposed third party custodian, the defense asked the court to lower the current $100,000 bail to $50,000 in property bond.
Hocog appeared under the custody of the Department of Corrections. He was arrested on March 4, 2010.
Hocog has denied charges of one count of voluntary manslaughter, one count of aggravated assault and battery, and assault and battery in connection with death of Larry Garcia Gonzales.
The charge of murder in the second degree was earlier dismissed by the court.
