Citing danger to the community and risk of flight, Wiseman granted the motion for stay and reconsideration earlier filed by Assistant Attorney General Brian D. Gallagher in connection with the earlier ruling to lower the cash bail to $75,000 and requiring Hocog to post 10 percent, or $7,500, and the remainder in property bond.
Wiseman acknowledged Hocog’s right to bail, and the court’s duty to protect the citizens and community from potential threat.
But he also noted the gravity of the case and the threat Hocog made to a co-accused whom the juvenile told not to talk to authorities.
Hocog is facing a maximum jail term of 30 years, or a minimum of eight years, for sexual assault, and a life imprisonment for kidnapping.
In an interview, Hocog’s counsel Joaquin Torres said his client is “innocent until proven guilty.”
Torres said their proposed bail modification was sufficient to ensure the appearance of Hocog during his pretrial service.
Hocog, Joseph Cabrera Camacho Jr., 31, Angel Jess Santos, 21, and Ivan Jones Castro, 33, were separately arrested by authorities on the charge of kidnapping and raping a Kagman student last June.
The court imposed a $100,000 bail on each of the four defendants who remain incarcerated at the Department of Corrections facility.
