Superior Court Associate Judge Kenneth L. Govendo scheduled a status conference for July 29, 2010.
In a stipulation, Assistant Attorney General Shelli Neal, who is representing the government, and attorney Edward C. Arriola, counsel for the defendant, stated that Fitial has retained a new attorney.
The Public Defender’s Office earlier represented the 26-year-old Fitial.
The Attorney General’s Office has charged Fitial with aggravated assault and battery, assault and battery, and disturbing the peace.
Fitial, who has denied the charges, is currently out on bail.
