Last January, during the scheduled sentencing for Calvo, 47, Presiding Judge Robert Naraja directed the Office of the Adult Probation to coordinate with the Federal Probation Office to help come up with a new presentence investigation report.
Assistant Attorney Brian Gallagher who prosecuted the case said he received the report on Tuesday.
“We would not be submitting a reply. The report is comprehensive,” Gallagher told the Variety.
Calvo’s attorney G. Anthony Long could not be reached for comment.
On Sept. 28, 2009, Calvo was found by a jury guilty of sexual assault in the second degree, and sexual abuse of a minor in second degree.
Calvo was subsequently found by the court guilty of sexual abuse of a minor in the third degree, and disturbing the peace.
He has been out on bail and released to his brothers as his third party custodian.
Calvo’s sentencing was originally set for Nov. 30, 2009, but this was moved to Dec. 7, 2009, which was then reset for Jan. 13, 2010.
Citing conflict of interest, Long moved to strike out the presentence report prepared by Probation Officer Simram Simram and submitted on Dec. 30, 2009.
Long said Chief Probation Officer Ursula Lifoifoi Aldan should have recused herself from approving the recommendation since her family was engaged in a business that was competing with that of Calvo’s.
