Moses gets 30 days for damaging six cars

During a change of plea hearing yesterday, Wiseman sentenced George I. Moses Jr. to two years of incarceration for the offense of criminal mischief, all suspended except for 30 days to be served without parole with credit for two days he already served at the Department of Corrections facility.

Moses will start serving the remaining 28-day jail term on Aug. 15, Wiseman ordered.

Assistant Attorney General Brian D. Gallagher prosecuted the case while Chief Public Defender Adam Hardwicke served as counsel for the defendant.

Moses will pay restitution to the owners of the six  vehicles he vandalized by jumping from one car to another, stomping his feet, and breaking their windshields on Dec. 27, 2009.

The vehicles were owned by tenants in an apartment complex behind Mobil San Jose.

Upon release from prison, Moses will be placed on two years of supervised probation.

The court referred Moses to the Community Guidance Counseling where he must successfully complete any recommended counseling.

He was required to pay a $25 court assessment fee, and a probation fee to be determined by the Adult Probation Office.

Moses will not possess or consume any alcohol while on probation, Wiseman ordered, adding that the defendant will also obey all CNMI and federal laws.

Moses was arrested sometime in 2006, together with two other minors, for theft, also in San Jose.

Court records showed that Moses pleaded guilty to criminal mischief, and was sentenced to six days imprisonment, all suspended with credit for the six days he had already served.

He was ordered by the court to pay $720 in restitution to his victim for destroying a payphone.
