Wiseman modifies bail of juvenile in Kagman kidnap-rape case

Superior Court Associate Judge David A. Wiseman yesterday reduced the $100,000 bail to $75,000, and required Hocog to post 10 percent, or $7,500, of it in cash.

Wiseman said a written order will be released regarding the details of the modified bail.

He noted the serious nature of the crime which he described as “grave,” adding  that “the court is not moved by the juvenile’s age.”

Wiseman also noted the threat made by Hocog to co-defendant Angel Jess Santos, 21, if Santos talks to the authorities.

Wiseman said Hocog faces a maximum sentence of 30 years for sexual assault.

Assistant Attorney General Brian D. Gallagher strongly opposed the motion for bail modification, citing Hocog’s danger to the community and risk of flight.

But Hocog’s defense attorney Jack Torres argued that the court may impose stringent conditions for his client’s pretrial release.

Hocog will turn 18 this Aug. 30, and the Attorney General’s Office moved that he will undergo adult proceedings, consistent with the Juvenile Justice Act, which the court granted.

Hocog, Joseph Cabrera Camacho Jr., 31, Angel Jess Santos, 21, and Ivan Jones Castro, 33, were separately arrested by authorities for kidnapping and raping a Kagman student last June.

The court has imposed a $100,000 bail on each of the four defendants who remain incarcerated at the Department of Corrections facility.
