Fitial has been charged with deprivation of rights under color of law when he used physical and verbal abuse against his female victim who was sexually abused.
Designated Judge Robert C. Najara granted the motion of 24-year-old Fitial who is now represented by attorney Joseph James Norita Camacho.
Naraja ordered that the expense of the investigator will not exceed $1,600.
In his motion for a court-appointed investigator, Camacho said “without discussing defense’s trial strategy, an investigator is needed to assist [the] defense counsel in additional investigation in order to mount a complete and proper defense.”
His client is unable to post bail and remains in custody of the U.S. Marshals Service and detained at the Department of Corrections facility since his arrest in June by federal agents.
Fitial’s jury trial is scheduled for Oct. 18, 2010.
