Man gets two days for hitting store owner

The 35-year-old Kapileo spent a total of two days in jail.

Superior Court Associate Judge Kenneth L. Govendo sentenced Kapileo to six months imprisonment, all suspended except for two days, with credit for the one day served from Jan. 9 to Jan. 10, 2010.

Kapileo signed a plea agreement as the Attorney General’s Office moved for the dismissal of the remaining charge of assault and battery.

On Jan. 7, 2010, Kapileo assaulted Jian An Ma, owner of Kwik Trip store in Tanapag, with a box of light bulbs being sold at the store.

Kapileo was placed on probation for six months under the direction and supervision of the Adult Probation Office.

Kapileo will write a letter of apology for Jian An Ma that will include “a promise that he will have no further altercation with the victim.”

During the probationary period, Kapileo is required not to have any contact with his victim, and must stay at least 300 feet away from Jian An Ma’s place of business in Tanapag.

Kapileo will pay $120 in restitution, payable to the Commonwealth Health Center for medical services rendered to the victim as a result of the incident.

Kapileo was required to pay the following: $1 for the value of the box of light bulbs destroyed during the incident; probation fee to be determined by the Adult Probation Office; $25 court assessment fee within 30 days; and a $200 fine.

Kapileo will be referred to and successfully complete any recommended course of counseling at the Community Guidance Center, including but not limited to anger management.

He must obey all CNMI and federal laws.

Assistant Attorney General Shelly Neal represented the government while Assistant Public Defender Douglas Hartig served as Kapileo’s counsel.
