NMC and the four regents who voted to terminate Fernandez’s contract were sued by the former president.
Regents Janet King, Paz Younis, Frank Rabauliman and Andrew Orsini were accused of violation of action under the color of law and conspiracy.
Regents Charles Cepeda and Maria Peter opposed the motion to fire Fernandez.
The college, for its part, was sued for wrongful terminal and breach of contract.
NMC yesterday said it will not provide public comments on pending litigation against the college.
But it will respond appropriately within the required timeframe, it added.
