Kelvin Fitial to serve 3 more days for assault

Superior Court Judge Kenneth L. Govendo yesterday sentenced Fitial to one year imprisonment, all suspended except for seven days with credit for four days already served.

The court ordered Fitial to report to the Department of Corrections on Sept. 5, and to be released on Sept. 8.

Upon release from prison, Fitial will be placed on one year probation.

The court ordered Fitial to pay a $500 fine, $25 in court costs  and a probation fee, the amount of which will be determined by the Probation Office. He will complete 120 hours of community work service.

Fitial will write a letter of apology to his victim, Scot Thompson.

The court  ordered Fitial not to threaten, harm, harass, or menace his victim, the victim’s family members, friends, acquaintances, and compatriots.

Fitial will submit to random drug screens for the entire term of his probation, the court said.

Fitial will attend and complete anger management counseling and any other counseling recommended by the Community Guidance Center, the treatment provider, or the Adult Probation Office.

Fitial was arrested on March 5, 2010, and was released on March 8, after posting $1,000 cash bail and a $1,000 unsecured or appearance bond.

The police report regarding the assault incident indicated that it was unprovoked and that Fitial, “for no apparent reason,” shouted obscenities at Thompson and his companion Jong Sung Kim.

When Thompson asked Fitial, who reeked of alcohol, “Is there a problem?,” the MMA fighter “threw about 15 to 20 punches to [Thompson’s] face.”
