The board, during its recent meeting, accepted the letter dated Sept. 1 from Big Boyz management.
John Reyes, Big Boyz consultant, said their decision to recall was based on their meeting with the board and Zoning Office Administrator Therese Ogumoro on Aug. 31.
“We felt that there is some information lacking for the Zoning Board to make a decision,” Reyes said.
He said should Big Boyz decide in the future to reapply for a conditional use permit, they will submit a new application.
Last August, the board scheduled a hearing for Big Boyz’s application for a conditional use permit.
Big Boyz wanted to open a commercial garage that would provide vehicle repair and custom painting services on Msgr. Guerrero Road in As Terlaje.
But Assistant Attorney General Kate Fuller, the Zoning Board’s legal counsel, suggested rescheduling the hearing so she could resolve the legal concerns raised by the lessee of the property and Big Boyz management.
