Federal court summons Miah for violating conditions of release, again

The U.S. Probation Office has petitioned the federal court to summon Miah to answer or show cause why his bail should not be revoked or modified.

Miah will be sentenced on Nov. 15, 2011 after he admitted the charge of conspiring to unlawfully produce and transfer CNMI driver’s license last August.

The federal court granted Miah’s request for his pretrial release last February, and he was placed under home confinement program with electronic monitoring as a condition. He was arrested last December.

On Sept. 10, 2011, Miah requested and received authorization to leave his residence to clean his laundry at a Laundromat in San Antonio.

A probation officer said Miah drove on Beach Road toward Chalan Kanoa.

The probation officer called Miah on his mobile phone and asked for the defendant’s location.

Miah told the probation officer he was in the parking lot of the laundromat.

The probation officer told Miah that he was behind the defendant’s vehicle.

Miah then stated that he was driving to another laundromat because the first location was full.

Miah was immediately ordered to return home, where he was counseled about not being truthful, and for deviating from his approved schedule without authorization.

Last August, after Miah admitted to Manglona that he possessed less than an ounce of marijuana,  his pretrial release conditions were modified.

In that violation hearing, the first to be presided by Manglona, she told Miah that the court was very hesitant in accepting the recommended modification, but said it was a fair resolution of the violation hearing and other consideration factored in.

Manglona reminded Miah to appreciate his liberty since he was under strict court order.
