Judge Kenneth L. Govendo ordered the release of Echalico to his mother as his third party custodian.
Govendo heard on Wednesday afternoon the motion for bail modification filed by Assistant Public Defender Matthew Meyer who is serving as Echalico’s counsel.
Assistant Attorney General Shelli Neal represented the government.
Police early this month arrested Echalico on charges of choking a Chinese roadside vendor, robbery and stealing the victim’s vehicle last July 7.
Govendo directed Echalico to stay away from the victim, and the victim’s employer.
Police have yet to arrest the two other defendants in this case.
The victim said he was selling farm produce in San Antonio, when Echalico approached him, and choked him after he did not sell cucumbers to the suspects for $2.
Another suspect drove off the vehicle with Echalico.
A witness said she later saw three male individuals running away from a burning pick-up truck in an open boonie area in Koblerville. The truck belonged to the victim.
