In her complaint, Veronica Cruz Velasco, through her lawyer Victorino DLG. Torres, said prior to the incident, she was about to buy doughnut at Himawari on or about March 14, 2011.
Velasco said she was walking through the parking lot and “unknown to her, there was a metal bar that was protruding from the ground.”
Velasco “tripped and fell violently to the ground where she suffered personal injuries,” her complaint stated.
Himawari has yet to submit its response to the court.
The complaint said the establishment failed to properly provide any warning sign about the protruding bended metal bar.
Velasco is asking for damages, costs and reasonable attorney’s fees, and for other relief.
