Dongjun Li is being held on the charge of immigration document fraud.
The U.S. District Court for the NMI yesterday ordered Li to remain detained pending further detention hearing.
Assistant U.S. Attorney Beverly McCallum moved for the continued detention of Li.
Court-appointed defense attorney Mark Scoggins argued for Li’s release.
Visiting federal Judge William Q. Hayes of the Southern District of California remanded Li to the custody of the U.S. Marshals Service after the hearing.
ICE special agent Paul C. Akeo Jr. said he received a telephone call from U.S. Customs and Border Protection supervisory officer Mark Layman about an individual, later identified as Li, who presented Form I-512 suspected of being counterfeit to Delta Airlines personnel as he attempted to check-in for an outbound flight to Los Angeles via Narita, Japan.
Upon reviewing Li’s documents, Akeo said: “I noticed numerous points of concerns.”
Akeo noted that the document erroneously indicated that U.S. Immigration and Naturalization Services co-existed with the U.S. Department of Homeland Security.
But the INS ceased to exist in 2003.
“Li’s Form I-512 bore the imprimatur of both INS and DHS. Additionally, the INS Form I-512 did not bear an Alien File number,” Keo said.
