Jurors deliberate on ‘ice’ case following closing arguments

Judge David A. Wiseman gave instructions to the six jurors after they heard the closing arguments of Assistant Attorney General Russel Lorfing, who prosecuted the case, and Chief Public Defender Adam Hardwicke, who served as counsel for Jing Xin Xiao.

The defense did not present any witness.

“Show me the money,” Hardwicke said several times as he referred to the prerecorded drug money.

Hardwicke said the prosecution “did everything” to portray the defendant as “an evil, Chinese drug dealer.”

Lorfing noted that the government’s 40 exhibits included the $300 marked money seized from the defendant.

Hardwicke said the prosecution “scrambled” when the defense asked for the marked money.

Lorfing said Detective Steve Castro testified that the authorized government funds used in drug cases were being recalled for auditing.

There was also testimony from three government witnesses that the marked money used in the operation was photocopied and accounted for, Lorfing said.

The prosecution also cited the over 13,000 tests made by a drug chemist, the government’s expert witness, who testified that three crystalline-like substances seized from the defendant yielded conclusive results as methamphetamine hydrochloride.

“She never makes a mistake,” Lorfing told the jurors, referring to the government’s expert witness from the Guam crime laboratory.

There were also eyewitnesses to the drug deal who testified in court, the prosecution said.

Hardwicke attacked the credibility of a cooperating defendant, a government witness, who was arrested by authorities for possession of a police-issued firearm.

The defense said the cooperating defendant turned in Jing Xin Xiao to escape prosecution.

But Lorfing said prior to the start of trial this week, the defendant came to the house of the cooperating defendant.

“If you testify, I am going away for a long time,” Lorfing quoted the defendant as having told the government witness.

Jing Xin Xiao has denied the charges of possession and trafficking of “ice.”

Police said 230 grams of “ice” worth $118,250 were seized last April from Jing Xin Xiao.
