Last defendant in green sea turtle poaching sentenced

Presiding Judge Robert C. Naraja placed San Nicolas, 29, on three years supervised probation under the direction and supervision of the Adult Probation Office.

Naraja said San Nicolas will write a one-page letter explaining how this conviction affects his family.

San Nicolas was required to pay a $100 fine payable within six months, a $25 court assessment fee within 30 days, and a $300 probation fee within one year.

Assistant Attorney General Benjamin Petersburg prosecuted the case, while Chief Public Defender Adam Hardwicke represented San Nicolas.

Neil Taisacan was the third defendant to plead  guilty.

He was sentenced to six months imprisonment, all suspended except for three months.

Taisacan started serving the remainder of his sentence on Jan. 7, 2011, and he is expected to be released on April 5, 2011.

The other defendants were Jimmy Manalo, 33, and Henry S. Ada, 31.

The court imposed six months imprisonment on Ada, all suspended except for the first 105 days.

The court included in Ada’s 105-day jail sentence the 15 days suspended for his  murder case in 2006.

Manalo was sentenced to six months in prison, all suspended except one month, with credit for time served.

On Sept. 5, 2010, the Attorney General’s Office said the four defendants conspired with each other and possessed a green sea turtle after it was unlawfully removed from Saipan waters.

The AGO thanked Assistant Attorney General Eileen Escudero Wisor who is assigned to the Coral Reef Initiative; the National Oceanic and Atmospheric Administration; the U.S. Fish and Wildlife Service; the Federal Bureau of Investigation; the Drug Enforcement Administration; the U.S. Attorney’s Office; the Turtle Advocate and Guardian Society, a newly formed group; and biologist John Starmer for their support in the investigation.
