AGO recommends 30-day jail term for ex-L&T supervisor in theft case

In a separate adjudicated case in federal court, De Zhu Sun had been sentenced for time served at the Department of Corrections facility after he pleaded guilty to attempted improper entry into a secure area at the Saipan international airport when he tried to evade sentencing in Superior Court last year.

Assistant Attorney General Benjamin Petersburg, who is representing the government, has recommended that De Zhu Sun, 32, be sentenced with five years imprisonment, all suspended except for a minimum of 30 days; ordered to pay a $500 fine; and placed on probation to commence following sentencing, and to last for the duration of his suspended sentence.

“The commonwealth’s recommendation serves the dual purposes of punishing the offender and deterrence to the community. The sentence is appropriate given [De Zhu Sun’s] perpetration of his crimes against his former employer, and defendant’s lack of any acceptance or responsibility,” Petersburg said.

De Zhu Sun was employed by L&T Corp. as supervisor from 1999 to 2003, according to court records.

De Zhu Sun failed to appear for his Jan. 19, 2011 sentencing in Superior Court because he was hospitalized, Variety was told.

Assistant Public Defender Douglas Hartig, who is representing De Zhu Sun, recommended that his client be sentenced to one week incarceration, pay a fine and do a substantial amount of community service.

“Incarceration beyond what he has already served in unwarranted. His lesson has been learned and society is protected by supervision. He should be allowed to work to support himself and his daughter [who is a U.S. citizen] and to continue to be a protective member of society, whether [in the commonwealth] or back in China,” Hartig said.

In Dec. 2009, De Zhu Sun was found guilty by a jury for receiving over 100 boxes of Polo shirts that were stolen from the L&T warehouse in Lower Base.

On July 21, 2010, De Zhu Sun’s scheduled sentencing in Superior Court, agents of the Federal Bureau of Investigation arrested the defendant after he presented to a Transportation Security Administration officer a Chinese passport that belonged to another person while attempting to board a plane.

The federal court placed De Zhu Sun on one year supervised release if deportation failed to occur and he was released pending further immigration proceedings.

He was sentenced by the federal court on Sept. 16, 2010.
