CUC, through attorney Deborah Fisher, informed Judge David O. Carter through e-filing on the day of the deadline.
CUC informed the federal court last December it would not meet its deadline.
“CUC has since that time properly completed a partial procurement for certain spill equipment items, and is now finalizing a contract,” Fisher told the federal court.
CUC, Fisher said, is “currently analyzing how best to purchase the balance of the items which were in the original solicitation.
Three years ago, the U.S. Justice Department and the Environmental Protection Agency signed and lodged two stipulation orders requiring CUC to bring its wastewater plants and collection systems, public drinking water systems, five power plants, and oil transfer pipeline into federal compliance.
Various representatives of the U.S. Environmental Protection Agency are permitted to attend a status hearing on Feb. 14, 2011 via teleconference, according to an order by Carter.
