Man gets five months for indecent exposure

Presiding Judge Robert C. Naraja sentenced Palacios, 24, to six months imprisonment, all suspended except for five months, with credit for 18 days he had already served at the Corrections facility.

The court dismissed the remaining charges, and the Attorney General’s Office agreed not to bring any additional charges.

The AGO also agreed to vacate its petition to revoke Palacios’ probation in a separate theft case.

For theft,  Palacios was sentenced to one year imprisonment, all suspended except for eight days with credit for eight days time served.

When Palacios committed  indecent exposure and disturbing the peace on Aug. 27, 2010, he was on five years probation.

Palacios will be placed on three years probation after his release from prison on July 16, 2011.

Palacios will write a one-page letter explaining how the conduct for which he was convicted affected his family.

He will also write a letter of apology to his victim, a neighbor.

During the probationary period, Naraja said Palacios will not to have any contact with his victim or any of her minor children.

Palacios may reside in his home in Dandan, “but may make no overt gesture to anyone with his victim’s family,” the court said.

Palacios may not step on the property of his victim, whether or not the family is present, the court added.

Palacios was required to pay a $500 fine  within one year after his release from custody, a $100 assessment fee, and a $300 probation fee payable within two years.

Police said Palacios peeped through the window of his neighbor and was seen outside his house fondling himself.
