Prosecution of woman in assault case suspended

THE prosecution of Nanami DLG Mafnas, who was charged with assault, has been suspended after she was accepted to the adult diversion program.

Superior Court Associate Judge Joseph N. Camacho last month granted the motion of Assistant Attorney General James Kingman to suspend the prosecution of Mafnas.

Kingman told the court that a diversion agreement has been delivered to the Office of Adult Probation.

Mafnas, represented by Assistant Public Defender Karie Comstock, has no objection to the suspension of prosecution. 

In a previous order, Judge Camacho vacated the bench trial scheduled for March 13 to allow the defendant to be evaluated for the diversion program.

The adult diversion program “is a voluntary alternative to criminal adjudication that allows a person accused of a crime to fulfill a set of conditions or complete a formal program designed to address, treat, or remedy issues related to or raised by the allegation. Upon successful completion of the conditions or program, the charges against the defendant are dismissed or not filed.” 

As part of the adult diversion program agreement, Mafnas agreed to perform 40 hours of community service, pay a $100 probation fee, and report to the CNMI Office of Adult Probation on or before the 5th of each month.

Mafnas was accused of assaulting a government attorney in March 2023, and was charged with one count of assault and battery, and one count of disturbing the peace.
