THE U.S. Marshals Service task force apprehended Fuquan Miao near the Chalan Kiya Mobil Gas Station on Wednesday afternoon for probation violation.

Miao was one of the 14 Chinese nationals arrested by U.S. Homeland Security Investigations after they paid an undercover agent, who was posing as a boat captain, to transport them to Guam illegally. 

The District Court for the NMI sentenced Miao to time served with one year of supervised release for conspiracy to transport illegal aliens in violation of 8 U.S.C. § 1324(a)(1)(A)(v)(I).

As a special condition of his supervision, Miao was ordered to voluntarily depart the United States within three months of sentencing if he was not eligible for expedite removal.

On Feb. 23, 2024, U.S. Probation Officer Gregory Arriola filed a petition for a summons, saying that Miao had failed to depart the U.S. within three months of sentencing. 

Three days later, the court issued the summons, but it was returned unexecuted after three attempts were made. 

Officer Arriola also filed a supplemental declaration after Miao failed to submit a monthly supervision report due in early March. Arriola said Miao’s cellphone account was no longer active.

 A hearing was held on March 6, 2024. Miao was not present, but his defense counsel David Banes was. Banes told the court that he, too, was unable to contact Miao. 

Special Agent Meilani L. Quintanilla likewise informed the court that she was unable to confirm if Miao had departed the U.S.

On March 6, 2024, Chief Judge Ramona V. Manglona issued an arrest warrant that was executed on Wednesday, April 10, 2024.

Miao will appear before Judge Manglona today, Thursday, April 11 at 10:30 a.m.
