Law firm objects to closed door meetings

A LAW firm representing Bank of Saipan yesterday objected to a closed door meeting between the bank’s receiver, Randall Fennell, and Superior Court Presiding Judge Edward Manibusan.

Calvo & Clark attorney Rodney J. Jacob requested that they be given notice and an opportunity to be heard before the court permits any ex parte proceedings.

Ex parte proceedings are done by, for, or with one side of a case without notice to the other side.

Jacob said they learned from news report that Fennell, as temporary receiver, had filed an ex parte motion, sealed a report and intended to meet with the court yesterday afternoon in a closed door private meeting.

“Respondent strongly objects to the receiver’s actions and any ex parte proceedings. Respondent has not been served with any such papers,” Jacob said,

Under the circumstances, Jacob said, a closed door ex parte meeting between the temporary receiver and the court would be highly improper.

“Indeed, respondent has asked this court to replace the temporary receiver in light of his serious conflicts of interest. The temporary receiver continues to refuse to serve respondent with any filings in this case,” he added.

Richard W. Pierce, counsel for the receiver, told Variety yesterday that the receiver simply reported to the court and that he had not seen any compelling reason why a Calvo & Clark lawyer should be there.
