The complaint was filed by World Resort Saipan against the NYBA and officers Roslyn Leon Guerrero, George Cruz, and Joe Diaz for breach of contract and violation of the Bad Checks Act.
World Resort Saipan through attorney Michael A. White demands judgment and has asked the court to order the defendants to pay the principal sum of $5,400, the interest on $2,700 at the rate of 9 percent per annum from Dec. 9, 2006, for interest on $2,700 from Nov. 24, 2006 at the rate of 12 percent per annum pursuant to the Bad Checks Act, for reasonable attorney’s fees, court costs, and for interest on the total of the foregoing at the maximum rate provided by law from the date of judgment.
The complaint stated that the NYBA and its officers signed a contract with the plaintiff on Nov. 24, 2006 and the hotel agreed to provide food and related services during the group’s award banquet.
The plaintiff stated that the “defendants failed, refused and neglected, and still fails, refuses and neglects to pay the said sums or part of it.”
The plaintiff added that the defendants issued check no. 301 drawn on the Bank of Guam payable to the hotel on Nov. 24, 2006 as partial payment of the defendant’s obligation. When the plaintiff deposited the check, it was returned due to insufficient funds. On May 5, 2008, World Resort Saipan sent a demand for payment of the same check to the defendants via certified mail but the defendants “still fail, refuse and neglect to pay the amount.”
