The complaint was filed by Yue Fang Xie Demapan through attorney Victorino DLG. Torres against Crispin Daque Beltran.
Demapan wants Beltran to pay her compensatory damages, economic and non-economic damages, for medical care and expenses, bodily injury and special damages, and for future damages at an amount which will be proven at a trial.
Demapan also wants Beltran to pay for her emotional distress and mental anguish, costs and attorney’s fees.
According to her complaint, Demapan was a rear passenger on a sedan traveling north on Beach Road in Chalan Kanoa on Feb. 17, 2008 while Beltran was driving south.
The complaint stated that Beltran failed to stop or yield to oncoming traffic and his vehicle collided with the sedan.
Beltran, the complaint added, breached his duties when he entered the oncoming traffic without stopping at a posted stop sign, which is a violation of the law.
As a result of Beltran’s negligence and recklessness, Demapan’s face smashed into the seat in front of her causing her severe pain and injuries, the complaint stated.
Beltran has 20 days to file his answer to the complaint.
