In a letter to Commerce and Trade Minister Otoichi Besebes, Young Chung , Assistant Minister for Korea’s Aviation and Railroad Bureau under the Ministry of Land, Transport and Maritime Affairs said that the talks will focus on the matter of substituting “substantial ownership and effective control” with principle place of business and regulatory control.”In previous discussions, Palau asked Korea to change the wording of the“substantial ownership/effective control” clause to enable Palau “to designate an airline based in Palau, its principal place of business in Palau and regulated by Palauan law.”Besebes has also asked the South Korean trade ministry to limit the bilateral agreement to flights between Korea and Palau and the leave the other rights to fly beyond Palau to future discussions.Besebes and David Shipper, President Remengesau’s legal counsel will represent Palau in the talks.
