Munson ordered the defendants to file any pre-trial motions not later than 3:30 p.m. on Nov. 10 following stipulations submitted by the defendants to the federal court through their lawyers.
Villagomez was represented by his counsel Joey San Nicolas; James Santos by Joaquin Torres, and Joaquina Santos by Ramon Quichocho.
The previous deadline for the defendants to file pre-trial motion was on Sept. 22, 2008.
On Sept. 17, 2008, the three defendants waived their right to a speedy trial, which the federal court granted.
Munson then set the jury trial for March 23, 2009, or more than six months from the original schedule, which was Oct. 6, 2008.
According to the stipulation separately submitted by the defendants need additional time to review to adequately prepare motions.
The Nov. 10 extension was the third that Munson granted to the defendants.
The original deadline was Aug. 25, 2008. It was extended to Sept. 8 after the defendants said they needed more time to prepare.
The defendant again filed a stipulation asking for another extension which the federal court granted. It was moved to Sep. 22.
The 12-page indictment stated that Villagomez, his brother-in-law James Santos, his wife Joaquina V. Santos and former Commonwealth Utilities Corp. Executive Director Anthony Guerrero initiated a scheme to defraud the federal government of thousands of dollars from Feb. 2, 1998 through business deals involving unnecessary purchases of chemicals for CUC.
Villagomez and the Santos couple pleaded not guilty while Guerrero entered into a plea agreement and pleaded guilty to the charges.
