Man gets 24-month jail term for possession of stolen firearms

The defendant, Edward Lee Santos, appeared with his counsel Loren Sutton. The U.S. government was represented by Assistant U.S. Attorney Beverly McCallum.

The U.S. government moved to seal the hearing, which the court granted.

The U.S. government moved for a 24 months imprisonment with credit for the time served, and a supervised release of three years which will include several conditions — “that the defendant shall not commit another federal, state or local crimes,  not possess a controlled substance; [and] shall submit to a drug test within 15 days of release from imprisonment and at least two periodic drug tests thereafter.”

The defendant is also prohibited from possessing a firearm or other dangerous weapons, submit to the collection of a DNA sample at the direction of the U.S. Probation Office.

He will participate in substance abuse treatment programs, perform 100 hours of community service, and pay a special assessment fee of $200.

The defendant has 10 days to file an appeal.

After the hearing, he was remanded to the custody of the U.S. Marshal Service.

Santos was charged with one count for felon in possession of firearms and one count for possession of stolen firearms.

He entered into a plea agreement on May 7, 2008.

According to the indictment, Santos, who was convicted of burglary, possessed a .223 caliber Bushmaster rifle and a .22LR caliber Ruger rifle sometime from Aug. 27 to Sept. 4, 2007.

The firearms were shipped and transported in interstate and foreign commerce before or after the firearms were stolen.
