Man who stole car battery ordered to post $1,000 bail

During the bail hearing yesterday morning, Judge Kenneth L. Govendo said if 47-year-old Diego S. Mundo would post bail, he had to comply with the following conditions: to return to court whenever required to do so; to obey all commonwealth laws; to surrender his travel documents and not leave Saipan, Tinian or Rota without permission from the court; to stay away from seaports and airportsl and have no direct or indirect contact with the victim or even go near the victim’s apartments.

Mundo appeared in court with his counsel Matthew J. Holley while the government was represented by Assistant Attorney General Jeffery Warfield Sr.

The court set Mundo’s arraignment for Sept. 29 at 9 a.m. and the preliminary hearing for Sept. 24 at 1:30 p.m.

Mundo was arrested yesterday in Susupe by virtue of a search warrant issued by Superior Court Presiding Judge Robert Naraja on Sept. 12.

In an affidavit, Detective Abraham Villagomez stated   that the Department of Public Safety received a call reporting a theft complaint at about 10:30 a.m. on Sept. 2.

Preliminary investigation showed that the defendant called the victim sometime during the last week of August.

The defendant asked the victim to borrow $50 because they had no water and he was going to use the money to pay the water company to fill up the water tank at the apartment.

The affidavit stated that the defendant never used the money because one of the tenants in the apartment complained of having no water that night.

The victim said Mundo left his apartment without any notice and failed to return the apartment key. It was also learned that Mundo took a car battery worth $89.
