Associate Judge Kenneth L. Govendo also placed Hilario Teigita Angui on unsupervised probation under the direction of the Office of Adult Probation.
Angui entered into a plea agreement with the commonwealth last month with his counsel Richard W. Pierce and pleaded guilty to theft charges. The court granted the commonwealth’s request to dismiss the remaining one count of burglary with the purpose of committing theft with prejudice.
Angui will pay a $25 assessment fee and a $100 fine. He will write a letter of apology to the victims, and complete 100 hours of community work service. He will receive counseling evaluation at the Community Guidance Center and obey all federal and CNMI laws.
Based on the affidavit of Detective Kevin R. Maratita, police received a call at about 6:30 a.m. on Oct. 12, 2007 regarding a burglary and theft incident at the Victory Chapel in Garapan.
Investigation by police authorities revealed that the chapel was burglarized and some DVD players and DVD disks were missing.
Records also revealed that at about 3 a.m. on Oct. 12, Patrol Officer Michael Camacho was doing his routine patrol within Garapan when he met the defendant carrying a box and was walking by the Hafa Adai bakery.
The defendant gave consent to Camacho to check the contents of the box that he was carrying.
The defendant told Camacho that he borrowed the DVD discs and player from a friend.
Camacho said he called other police officers who were in the vicinity for assistance and they took the serial numbers of the items inside the box the defendant was carrying.
When the defendant was brought to the Criminal Investigative Bureau for questioning, he signed a statement and named another individual identified as Julian M. Sablan.
Police said that while Angui and his co-defendant Sablan went outside the house, they looked into one of the smaller boxes the defendant was carrying earlier.
Angui and Sablan told police that they went back to the Victory Chapel to “clean up their mess.”
On Oct. 22, 2007, Sablan was invited to the CIB office.
Sablan then told police that he saw Angui at around midnight on Oct. 12 but he denied any involvement in the case.
On Nov. 26, 2007, police invited Angui to give his statement at the CIB. Angui admitted he saw Sablan running away from the Victory Chapel holding three boxes.
Angui said when he confronted Sablan, the later told him he was returning the boxes to his friends.
He said Sablan gave him one box to carry and that was when police stopped him.
A review of the defendants’ records showed that they both have been arrested and have pending cases of robbery, theft, theft of vehicles and burglary and theft.
Sablan will enter into a change of plea with the commonwealth on Nov. 6, 2008 at 9 a.m..
