Associate Judge David A. Wiseman imposed a bail of $2,500 on Henry Ernie U. Hofschneider, $500 of which is cash and $2,000 in unsecured bond, but he was only required to post 20 percent of the total bond amount.
The 52-year-old defendant appeared for bail hearing represented by his counsel J.P. San Nicolas. The government was represented by Assistant Attorney General Rebecca Warfield.
Wiseman set the arraignment for Dec. 12 at the Tinian courthouse.
According to the affidavit filed by Tinian Police Officer Barbara K. Arend, DPS 911 got a call from a girl asking them to pick her up at about 3:10 a.m. on Oct. 2, 2008.
According to the statement of the caller, she woke up in her room and heard the defendant and the victim engaged in a shouting match. When she went out to check, she saw the defendant slapping the victim.
The victim slapped the defendant back on the face and fell to the floor.
The caller said the defendant then told her to go back to her room because the victim was just drunk.
Once inside her room, the caller told the police that the victim kept shouting and asking her to call the police for assistance.
