Associate Judge David A. Wiseman yesterday ordered 48-year-old Bernardo E. Pineda to report to the court for the arraignment of his case on Nov. 17 at 9 a.m., and at the preliminary hearing set for Nov. 10 at 9 a.m.
Pineda appeared in court with Assistant Public Defender Douglas Hartig while the government was represented by Assistant Attorney General Jeffery Warfield.
The defendant is ordered to appear in court for all scheduled hearings, obey all commonwealth laws, not leave Saipan and stay away from airports and seaports, and have no direct or indirect contact with the victim.
Detective Simon T. Manacop, in his affidavit, stated that at 4:26 p.m. on Nov. 1, the Department of Public Safety received a call reporting a domestic incident case across from the Saipan cockpit in Garapan.
Manacop said the caller informed them that her boyfriend had beaten her again.
Police responded to the call and saw the victim walking with her son in the parking lot of the Bank of Saipan in Garapan.
The victim showed police the blood stains on her left thigh and a cut about half an inch in diameter on her left wrist.
Manacop said the victim told him she was not sure about how she got the cut on her wrist.
Police then arrested the defendant who was sleeping at their apartment at that time.
He was transported to the Department of Corrections for booking and detainment.
During the investigation, the victim told police that Pineda started drinking at 10 a.m. that day with some friends.
At about 3:30 pm., Pineda picked a fight with her, claiming that a DVD that he bought earlier was the wrong one.
The victim said the defendant hammered the DVD and tried to hammer their television set, too, but she stopped him.
She said the defendant then shoved her.
The victim also told police that it was not the first time that her boyfriend beat her up but she was scared to call for assistance in the past.
