Man sexually assaults and robs woman along jogging pathway

Superior Court Associate Judge Kenneth Govendo set at $21,000 cash Alfred Obak’s bail. The suspect who is charged with robbery and second degree sexual assault and assault and battery failed to post bail.

His preliminary hearing is set for Dec. 22 and arraignment is set on the 29th at 9 a.m.

According to the sworn statement of Detective Abraham C. Villagomez submitted to the court, police received a robbery report on Dec. 12 around 7:10 p.m. from the victim.

The victim said she was walking south on the pathway along Beach Road San Jose near the Oleai Beach Bar & Grill when the suspect pushed her forward to the ground.

When she fell, Obak touched her private parts and groped her right breast.

The victim fought back and kicked the suspect.

But her strength was no match to his and so she screamed and that’s when the suspect stopped attacking her.

“The male then grabbed her right ankle and began pulling her to the beachside. The male individual began choking her throat but the victim screamed again and that’s when the male individual ran north along the beach side and she called 911,” Villagomez stated.

The police immediately responded to the scene. Police Sgt. Sylvan Rangamar who overheard the report found the suspect at the CUC Pump Station No. 12 by the beach side, sweating profusely.

The victim was brought to their location and positively identified Obak as the person who attacked her.

During interrogation, Obak said family problems drove him to commit the crime.

He said he spent his last money on beer and had marijuana before the incident.

“Obak stated he was having problems with his family and that’s why he went to Oleai Bar and robbed the lady. Officer Paul advised him that he was already informed about his Miranda rights and he should remain silent. Obak stated that he did not care and that he also had marijuana in his backpack,” the written testimony of the detective reads.

“Obak stated that after he finished his last beer he saw the lady pass by on the pathway so he followed until he got close to the Oleai Beach Club and then tried to rob her. He then said he started feeling for a wallet or a purse, touching her chest area and her buttocks,” it added.
