Ying Lian Yao filed her request with Associate David A. Wiseman through her lawyer, Robert Torres.
The defendant is asking to be released to a third-party, Wang Jian Guo, on an unsecured bond of $5,000.
Torres is asking the court to have the manager of Fei Ma Industrial Co. Ltd., doing business as Parliament Bar, to be the defendant’s third-party custodian.
The lawyer said if released, the defendant will have room to stay at the building behind the bar and that the proposed third-party custodian knows his responsibility to ensure that the defendant appears for all court hearing. He can also supervise her.
The defendant was charged with one count for possessing ice on Nov.7, 2008.
On Nov. 11, the court ordered the defendant to post $10,000 cash bail and to appear in court for all hearings. She was also told to surrender her travel documents and stay away from airports and seaports.
The defendant, who resides in San Antonio, was arrested after Associate Judge Kenneth Govendo signed an arrest warrant for 29-year-old Zhang Zhou Fan, the defendant’s husband on Nov. 7, 2008 for illegal possession of controlled substance.
Members of the local drug enforcement task force followed the vehicle operated by Zhou toward the airport on the night of Nov. 7. Upon conducting a search, police operatives found ice in between a folded newspaper hidden in the pocket of the defendant.
