Wiseman also sentenced Mario Besana to three years probation for each count of charges to run concurrently.
The 52-year-old defendant, who was represented by Assistant Public Defender Matthew Holley, will have to pay a $100 fine, a $25 court assessment fee and a restitution amounting to $1,490.
He must write a letter of apology and have no contact with the victim. He will also render 50 hours of community work service at a minimum rate of five hours per month.
He will have to seek and maintain full time employment and follow all directives of the Probation Office.
The court ordered that the bail the defendant posted will pay for the fines and probation fees.
The defendant was charged with one count of theft by deception, one count of theft by unlawful taking or disposition, and one count of theft by failure to make the required disposition of funds.
The defendant entered into a plea agreement on Nov. 19 and pleaded guilty to count 1 or theft by deception in the information. The government agreed to dismiss the other charges.
The defendant took $1,490 from a salon in Garapan from Dec. 13, 2007 to Jan. 17, 2008.
Detective Patrick Earl Maanao stated in his affidavit that the owner of @Hair.com asked the defendant to pick up rental payment from Mr. Cho.
The defendant told his employer that Cho was off island.
When the owner asked another person to check if Cho was back on island, it was discovered that Cho had already made the payment to the defendant, and had a receipt issued by the defendant to prove it.
When the owner tried to ask the defendant about it, Besana said he had not collected the payment yet.
It was later found out that the defendant tore out one sheet from the receipt book which he issued to Cho.
