Sir Allan was jailed for ordering ex-militants to attack Honiara law firm Sol-Law in 2002 when he was prime minister. He automatically lost his Savo/Russells seat, but parliament recently passed a motion for Sir Allan to retain the seat pending his appeal against the six month jail term, which is expected to come before the court in June this year.
This means Sir Allan continues to enjoy the privileges of a member of parliament until the court decides on his case.
Deputy Commissioner Administration Correctional Services Heinz Konga said Sir Allan was supposed to be released on New Year’s Day but it is a prison policy that he could not be released on a public holiday so he had to be released a day earlier.
Konga added this policy not only applies to Sir Allan but every prisoner and this had also happened in the past.
Sir Allan, one of the longest serving MPs, is currently in his home village on Savo and could not be reached for comments.
