Two men arrested for ice, assault and battery

In yesterday’s bail hearing, Superior Court Associate Judge David A. Wiseman imposed a $5,000 cash bail on 28-year-old Milton Borja Camacho for beating her girlfriend on Monday evening.

Wiseman subjected Camacho to several court conditions and ordered him to stay away from the victim.

In her affidavit, Detective Andrea C. Ozawa stated that a male called the Department of Public Safety at about 9:51 p.m. on Jan. 19, 2009 reporting a domestic violence incident at the AM&L apartment in Chalan Kanoa.

A witness told responding police officers that she saw Camacho beating up his girlfriend.

The witness said the couple were outside arguing and the defendant was choking, slapping and punching the victim when they heard the police coming.

The witness said the defendant immediately pushed her girlfriend inside a room and they locked themselves in.

Police said they knocked but there was no answer.

After several attempts, the police made a forced entry because they were not sure if the victim was safe or in danger.

Police found the victim on the restroom floor with numerous injuries all over her body.

The victim told police that the defendant covered her mouth and nose to stop her from screaming.   

The discovery of a bag containing drug paraphernalia in the couple’s house resulted in the arrest of the second defendant, Benefacio Magofna Camacho.

Wiseman also imposed a $5,000 cash bail on Camacho and placed him under several court conditions.

Documents showed that the police officers who responded to the domestic violence incident saw a man and a woman running away upon seeing them approaching.

Police stopped the man, later identified as Camacho, and asked him why they were running away.

The defendant agreed when police asked to conduct a search on him, and the search led to the recovery of drug paraphernalia and a Ziplock bag containing a substance which proved to be presumptive for ice.

The defendant was arrested for illegal possession of a controlled substance and was transported to the Department of Corrections where he was booked and detained.  

Camacho was represented by Assistant Public Defender Matt Holley. Chief Prosecutor Kevin A. Lynch appeared on behalf of the government.

Wiseman said the pretrial release conditions he imposed on the defendant on Aug. 29, 2008 for another case will be incorporated with the conditions set on this case.

The court acknowledged the oral declaration of the Probation Office to revoke the defendant’s probation on other criminal matters because he failed to comply with the conditions.

Wiseman set the arraignment and revocation hearing on four separate cases against the defendant for Feb. 2, 2009 at 9 a.m. The preliminary hearing is set for Jan. 28, 2009 at 9 a.m.

Upon investigation, it was learned that both defendants were on probation.

Wiseman set the preliminary hearing for both defendants on Jan. 28, 2009 at 9 a.m. and the arraignment for Feb. 2, 2009.
